米国源泉所得

米国源泉所得（U.S. Source of Income）の決定方法

　米国税法上Resident に該当する場合は、すべての所得（源泉地を問わず）申告対象となるため、米国源泉所得（U.S. Source of Income）であるか否かを考慮する必要はありません。しかし、米国税法上Non Resident の扱いを受けた場合、申告の対象となるのは米国源泉所得のみとなります。この場合、何をもって米国源泉とするのか、知っておく必要があります。

　以下に、米国源泉所得（U.S. Source of Income）について、一般的な米国税法上での決定方法を示します。

Pay for personal services （役務の対価）	サービスを遂行した場所（Where services are performed）
Business Income： Sale of Inventory （商品の販売）	一般に売った場所（Where Sold Allocation）
Dividends （配当金）	会社設立の国（Type of corporation (U.S. or foreign)）
Interest （利子所得）	支払い主の居住地（Residence of payor）
Rents （賃貸収益）	動産または不動産の所在地（Where property is located）
使用料など（Royalties - Patents, Copyrights, Etc.）	使用された場所（Where property is used）
鉱物資源の使用量など（Royalties - Natural resources）	資源の所在地（Where property is located）
年金（Pensions due to personal services performed）	サービスを遂行した場所（Where services were performed while a nonresident alien）
奨学金など（Scholarships and fellowship grants）	一般に支払い主の居住地（Generally, residence of payor）

　米国税法上Non Resident 扱いの方は、これらのうち米国源泉となる所得が申告の対象となります。なお、これには日米租税条約が関係したり、例外のルールも存在しますので、上記は一般的な内容のみとなります。
